Resisting Arrest & Protective Custody
Officers can be injured when a subject refuses to come along peacefully and submit to arrest. During the struggle to restrain, handcuff and or place the subject in the police cruiser, officers are frequently injured in a manner which can be long lasting and disabling. We have also represented many officers who were injured while placing an intoxicated or otherwise out of control person into protective custody. Due to their intoxication from alcohol, narcotics, and/or an overdose of prescription medication, many of the resisting subjects are impervious to pain and conventional restraint techniques. In some cases, a subject's failure to take prescribed medication leaves the subject out of control and violent, making it difficult to safely restrain and remove them.
When an officer sustains an injury during a resisting arrest or placing a subject into protective custody, the officer may face difficulties throughout multiple areas of life. In addition to painful injuries, an injured officer may be temporarily or permanently unable to perform the essential functions of police work and therefore be required to lose out on much needed income on which they rely for support and in some cases they are involuntarily forced to retire early. After a career ending injury the officer is usually unable to find another career to support themselves since their training and skills are not transferable over to the private sector. At Ballin & Associates, our Massachusetts police injury attorneys have helped countless injured police officers obtain compensation they deserve.
